Alleged Rape: Court Sends Complainant To Prison


One Stella Bassey Leo, female, who gave her age as 17 years has been sent to the Uyo Federal Prison for Accessory after the Fact.
Stella incurred the wrath of justice Iniabasi Udobong of Abak High Court II when she wanted to withdraw from suit number HA/50c/2017 instituted against Mr. Iniobong Sunday Peter and Inibehe Patrick.
The two accused had been in prison custody in Ikot Ekpene prisons since their arraignment on April 7, 2017 on a two court charge of Attempted rape and stealing.
The attempt to rape her, according to her, took place at Ikot Ifang, Midim Clan, Abak LGA. Sometimes last year. I.U. Robberts Esq represented the State while Mrs. Gladstone was for defense.
The court demanded that the complainant step forward to state her case if she was present. She swore on the holy bible in the witness box as she stated thus, “I Stella Bassey Leo do not intend to continue in this case anymore.” The court demanded to know why. She paused for a long-while, looked around, as the court again urged her to state her reasons.
She told the court that it is “because we have settled the matter at home in my village in Adiasim Ikot Ekon.” Prompted to state any other reason, she said that she is in school in Ebonyi State without giving particulars of the School and address.
At that point the court sought to know if she knew the length of time the two accused have spent in prison, she replied, “I don’t know.”
The court then asked Senior State Counsel – Nancy Idungafa Esq to read the law on accessory after the fact and compounding felony to her.
Defense counsel read section 10 (1) of the criminal code cap 38, laws of Akwa Ibom State and interpreted same to her in Annang language.
The court then ruled that the complainant, Stella Bassey Leo has offended section 10 (1) of the criminal code cap 38, laws of Akwa Ibom State by knowingly standing on the path of justice against crime.
Accordingly, he ordered the Attorney General and commissioner for Justice to institute an action against the complainant. Meanwhile, the court ordered that Stella Bassey Leo be remanded in the Uyo Federal Prison pending the hearing of the case, which was adjourned to April 11, 2018.
